1. Introduction & Purpose of this Policy

(collectively referred to as AWV) provides real estate services including Residential, Commercial and Development Consultancy.

AWV is an organisation bound by the Privacy Act 1988 and is committed to managing personal information in accordance with the Australian Privacy Principles (APPs).

This Privacy Policy explains how AWV collects, holds, uses and discloses personal information, including:
– the scope of this Privacy Policy;
– why we collect personal information;
– what personal information we collect;
– how we collect, use and disclose personal information;
– how you can access and correct your personal information;
– how we protect personal information;
– how you can make a privacy complaint; and
– how to contact us about privacy matters.

 Where practicable, this Privacy Policy is supported by collection notices provided at or before the time we collect personal information.
AWV may review and update this Privacy Policy from time to time.

2. Scope

This Privacy Policy applies to all personal information collected, held, used or disclosed by AWV and must be complied with by all employees, contractors and other persons who handle personal information on our behalf.

This policy applies to independent contractors, job applicants, suppliers, clients, customers and other individuals who interact with AWV.

For the avoidance of doubt, job applicants and contractors are not covered by the employee records exemption under the Privacy Act.

3. What is personal information?

Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not and whether recorded in a material form or not. Personal information may be collected directly from you or from third parties where lawful.

4. Why do we collect personal information?

We collect personal information for purposes including:
– carrying out our real estate functions and activities;
– providing products and services requested by you;
– communicating with you;
– managing and improving our services;
– administration, billing and debt recovery;
– recruitment and engagement processes; and
– marketing our products and services where permitted by law.

We may also collect, use or disclose personal information where required or authorised by law, or with your consent.

5. What personal information do we collect?

5.1 General collection

The type of personal information we collect depends on the nature of your interaction with AWV and may include:
– name, address, email address and telephone number;
– information about organisations you represent;
– details of transactions and interactions with AWV; and
– information you provide to us voluntarily.

 You may choose not to provide personal information, however this may limit our ability to provide services to you.

5.2 Candidates

When recruiting personnel, we may collect personal information such as contact details, qualifications, work history, resumes and references. Health or emergency contact information will only be collected where lawful, reasonably necessary and with your consent or as required by law.

 5.3 Suppliers

If you are a supplier, we may collect information such as your name, business contact details, billing information and records of goods or services supplied.

 5.4 Events and recordings

If you participate in an event delivered or managed by AWV, we may take photographs or audio-visual recordings that identify you. Where practicable, notice will be provided.

 5.5 Sensitive information

AWV does not generally collect sensitive information. Where sensitive information is collected, it will only be where:
– you have given explicit consent; and
– the information is reasonably necessary for AWV’s functions or required by law.

6. Employee records

This Privacy Policy does not apply to employee records where the handling of personal information is directly related to the employment relationship, as permitted under the Privacy Act 1988 (Cth). 

7. How we collect and hold personal information

We generally collect personal information directly from you via phone, email, online forms, contracts, transactions, social media or in person. We may also collect personal information from third parties or publicly available sources where lawful.

If we receive unsolicited personal information, we will determine whether it could have been collected under the APPs. If not, we will destroy or de-identify it where lawful and practicable. Personal information is stored in secure electronic systems and physical files, including with trusted third-party service providers. We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure.

While no system can be guaranteed to be completely secure, AWV takes reasonable technical and organisational measures appropriate to the nature of the information to protect personal information transmitted online. We take reasonable steps to destroy or de-identify personal information when it is no longer required.

8. Internet use and cookies

You may visit AWV websites without identifying yourself. If you provide personal information online, it will be managed in accordance with this Privacy Policy.

Our websites use cookies to improve functionality and user experience. You may control cookies through your browser settings, noting this may affect website functionality.

Our websites may contain links to third-party websites. AWV is not responsible for the privacy practices of those websites.

9. Use and disclosure of personal information

AWV uses and discloses personal information for the purposes for which it was collected, or where otherwise permitted by law.

We may disclose personal information to:
– service providers and contractors engaged to assist in delivering our services;
– clients, venues and stakeholders where reasonably necessary; and
– related or affiliated companies of AWV.

Direct marketing

AWV may use personal information to send direct marketing communications where you have consented or where you would reasonably expect us to do so. All marketing communications include a functional unsubscribe mechanism.

AWV complies with the Spam Act 2003 (Cth). You may opt out of marketing communications at any time, free of charge. 

10. Anonymity and pseudonymity

You may deal with AWV anonymously or using a pseudonym where lawful and practicable. We may require identification where required by law or where it is impracticable to do otherwise.

11. Overseas disclosure of personal information

Some of our service providers may be located overseas. Where personal information is disclosed to overseas recipients, AWV takes reasonable steps to ensure the recipient complies with the APPs or is subject to substantially similar privacy protections, unless an exception under APP 8 applies.

12. Access and correction

You may request access to personal information held by AWV by contacting our Privacy Officer. Requests will be handled within a reasonable time. You may request correction of personal information if you believe it is inaccurate, out-of-date, incomplete, irrelevant or misleading. We will take reasonable steps to correct the information or explain why correction is refused.

13. Complaints

If you have a concern about how AWV has handled your personal information, you may contact our Privacy Officer. We will investigate and respond within a reasonable period. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner.

14. Notifiable Data Breaches

In the event of an eligible data breach, AWV will comply with its obligations under the Notifiable Data Breaches scheme, including notifying affected individuals and the Office of the Australian Information Commissioner where required.
